1Introduction

Welcome to thisisagency.ai. By accessing our platform and interacting with our AI agents, you agree to be bound by these Terms of Service and our Privacy Policy. Please review them carefully. If you do not agree, do not use the Service.

2Beta Service Notice

Beta ends when we announce General Availability (GA). We will give at least 14 days' notice before GA, at which point updated Terms may apply. Nothing in this Beta notice limits liability that cannot be limited by law (see Section 14).

3Age Restriction

You must be at least 18 to use thisisagency.ai. By creating an account you represent that you are 18 or older. We may suspend or terminate accounts where we believe this requirement is not met.

4AI Outputs & Your Responsibility as Publisher

You acknowledge that you are interacting with artificial intelligence. AI outputs are for informational and creative purposes and may be inaccurate, incomplete, or unsuitable for a given purpose.

You act as the Publisher. You are responsible for fact-checking, reviewing, and verifying any content before using or publishing it. To the fullest extent permitted by law, we assume no liability for the accuracy, reliability, or outcomes of AI-generated content.

5No Professional or Regulated Advice

Our AI agents are not certified or licensed professionals and do not provide legal, medical, tax, accounting, insurance, or financial advice. Any budgeting, VAT, debt, mortgage, banking, energy, or similar information the platform generates is general information only, produced by automated systems, and must not be relied upon as advice.

We are not authorised or regulated by the Financial Conduct Authority (FCA) and do not carry on any regulated activity, including regulated debt counselling, debt adjusting, mortgage advice, or investment advice. You should consult a suitably qualified, licensed, and (where relevant) FCA-authorised professional before acting on any output.

You are solely responsible for decisions you make based on outputs from the platform.

6Data Processing, Scraping & Email Authorisation

By submitting URLs, you authorise our systems to autonomously fetch and process content from those domains on your behalf, and you represent that you have the right to do so and will respect applicable robots directives, rate limits, and the target site's terms.

By using our AI Inbox and Receptionist, you authorise the platform to parse, store, summarise, triage, and (where you enable it) send emails, and you confirm you are authorised to grant access to the mailbox(es) concerned.

By connecting a social media, publishing, or content-management account (for example X, Facebook, LinkedIn, a WordPress or other CMS, or a newsletter platform) and instructing the platform to create, schedule, or publish content, you authorise the platform to create, schedule, publish, and manage content to those accounts on your behalf, and you represent that you have the right to do so and will comply with each connected platform's own terms and policies. You remain the Publisher of that content (see Section 4): you are responsible for reviewing it before it is published and for making any legally required disclosures, including identifying advertising, sponsorship, or affiliate content and labelling AI-generated or AI-assisted content where applicable law requires.

Your interactions build persistent "Topical Experience" memory for your account. You are responsible for the sensitivity of the data you submit, and you must never submit raw passwords or security credentials into the chat. Where you process other people's personal data through the platform, you are the controller of that data (see Section 12).

7Voice Calls & Caller Consent

If you enable the AI Receptionist or Call Centre, calls may be recorded, transcribed, and processed by AI and third-party voice providers. You are responsible for providing any legally required notice to, and obtaining any required consent from, callers (which varies by jurisdiction), and for configuring an appropriate in-call notice. You must not use the calling features for unlawful, harassing, or deceptive purposes.

8Acceptable Use Policy

You agree not to use the platform to:

• Generate or distribute illegal, harassing, defamatory, or CSAM (Child Sexual Abuse Material) content.
• Direct the agents to generate malware, conduct cyberattacks, or engage in unauthorised scraping of protected data or personal data.
• Reverse-engineer, exploit, bypass, or "jailbreak" the underlying AI prompts or agent systems.
• Use developer utilities or the Agent Playground for unauthorised security testing, malicious injection, or probing. Developer utilities are reserved for designated administrative accounts.

Violation may result in immediate suspension or termination without refund of any consumed or non-refundable credits.

9Credits, Billing & Refunds

• Credits: paid features consume credits or a subscription. Prices and credit costs are shown before purchase and may change for future purchases.
• Digital content & cancellation: credits and subscriptions are digital content supplied immediately. Where you are a consumer with a statutory right to cancel (e.g. under the UK Consumer Contracts Regulations), by purchasing and requesting immediate access you consent to immediate supply and acknowledge that you lose the 14-day right to cancel once the digital content or service has begun to be supplied. Nothing here affects statutory rights that cannot be waived.
• Refunds: except as required by law or expressly stated, purchased credits and subscription fees are non-refundable. Where a chargeable task fails or is aborted by the system (for example, a scan blocked by a target site), the credits for that task are automatically refunded to your balance.
• Promotional & referral credits have no cash value, are non-transferable, may expire, and may be revoked in cases of abuse.
• Chargebacks / non-payment: we may suspend access for unpaid, reversed, or disputed charges.

10Intellectual Property

Your Content: you retain all ownership of the inputs, documents, and data you upload. To the extent we hold any rights in the specific textual output generated for you from your inputs, we assign those rights to you. You acknowledge that AI-generated output may not be eligible for copyright protection and that third-party AI providers' terms may also apply to outputs.

Our IP: we retain all intellectual property rights in the platform, interface, software, agent architecture, prompts, and aggregated "Topical Experience" systems.

11Affiliate Program & Referral Rewards

Referrers may earn promotional credit rewards under the following conditions:

• Verification: referred users must register and complete email double opt-in verification. Unverified signups do not qualify.
• Deferred Payout: rewards are credited only upon the referred user's first successful billing transaction.
• Abuse Prevention: synthetic, self-, or deceptive referrals are prohibited. We may audit affiliate activity and revoke rewards or suspend accounts for abuse.

12Data Protection & Processing

Our handling of personal data is described in our Privacy Policy. Where you use the platform to process personal data about your own contacts, customers, or callers, you are the controller and we act as your processor on your documented instructions. Business users may request a Data Processing Agreement (DPA) at privacy@thisisagency.ai. You are responsible for having a lawful basis and any required notices/consents for personal data you introduce to the platform.

13Indemnification

You agree to defend, indemnify, and hold harmless thisisagency.ai and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your violation of these Terms, your use of the platform, the personal data you introduce, or content you generate and publish, including claims of copyright infringement, unauthorised scraping, or unlawful call recording.

14Limitation of Liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law (including your non-excludable statutory consumer rights).

SUBJECT TO THE ABOVE, TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THISISAGENCY.AI BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL.

SUBJECT TO THE ABOVE, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) GBP 100.

15Warranty Disclaimer

EXCEPT AS EXPRESSLY STATED AND SUBJECT TO YOUR NON-EXCLUDABLE STATUTORY RIGHTS, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free, or that AI outputs will be accurate, complete, or suitable for any purpose.

16Termination

Either party may terminate at any time. You may close your account directly from your Account Settings page or by contacting privacy@thisisagency.ai. We may suspend or terminate access immediately if you breach these Terms or the Acceptable Use Policy.

On termination, your data is handled per our Privacy Policy: personal data and AI memory are deleted from live systems within 30 days (with limited backup retention as described there). You can export your account data at any time from your Account Settings page.

17Force Majeure

We are not liable for failure or delay resulting from circumstances beyond our reasonable control, including natural disasters, acts of government, internet or infrastructure outages, third-party service failures, or cyberattacks.

18Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

19Governing Law & Jurisdiction

These Terms are governed by the laws of Scotland and the United Kingdom, and disputes are subject to the exclusive jurisdiction of the Scottish courts. If you are a consumer, you may also have the benefit of mandatory provisions of the law of your country of residence.

20Severability & Entire Agreement

If any provision is held invalid or unenforceable, the remaining provisions remain in full effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and thisisagency.ai regarding the platform and supersede all prior agreements on that subject.
