2Beta Service Notice

The Beta period will end when thisisagency.ai publicly announces General Availability (GA). We will provide at least 14 days' notice before transitioning to GA, at which point updated Terms may apply.

3User Responsibility & Publishing Liability

You acknowledge that you are interacting with artificial intelligence entities. The output generated by these AI agents is for informational and creative purposes.

You, the user, act as the Publisher. You are entirely responsible for fact-checking, reviewing, and verifying any content generated by the platform before using or publishing it. thisisagency.ai assumes no liability for the accuracy, reliability, or outcomes of using AI-generated content.

4No Professional Advice

The AI agents on this platform are not certified professionals. They are restricted from and do not provide legal, medical, or financial advice. Any guidance or analysis provided by the system should not substitute for consultation with licensed professionals in the respective fields.

5Data Processing, Scraping & Email Triage Authorization

By submitting URLs for analysis, you authorize thisisagency.ai's systems to autonomously scrape and process content from those domains on your behalf. You represent and warrant that you have the right to analyze the submitted websites.

By using our live AI Inbox and automated Receptionist systems, you authorize the platform to parse, store, summarize, and triage incoming and outgoing emails. We log transactional communications and system rate-limits to audit dispatch reliability and maintain security.

Furthermore, you acknowledge that your interactions with our agents are recorded to build persistent "Topical Experience" memory for your account. Certain features — such as the Accountant agent (Stephen) — are specifically designed to process financial data you choose to provide, including bank statements, expenses, and invoices. You remain responsible for the sensitivity of the data you submit and should only upload records you are comfortable having processed by our AI systems. You should never submit raw passwords or security credentials into the chat system.

6Acceptable Use Policy (AUP)

You agree not to use the thisisagency.ai platform to:

• Generate or distribute illegal, harassing, defamatory, or CSAM (Child Sexual Abuse Material) content.
• Direct the AI agents to generate malware, conduct cyberattacks, or engage in unauthorized scraping of protected data.
• Attempt to reverse-engineer, exploit, bypass, or "jailbreak" the underlying AI prompts and agent systems.
• Utilize the gated Agent Playground environment `/office/playground` or developer tools for unauthorized security testing, malicious injections, or probing. Access to developer utilities is strictly reserved for designated administrative accounts.

Violation of this AUP will result in immediate account termination without refund.

7Intellectual Property Rights

Your Content: You retain all ownership rights to the raw inputs, documents, and data you upload to the platform. We assign to you all rights, title, and interest in the specific textual output generated by the AI based on your inputs.

Our IP: thisisagency.ai retains all intellectual property rights to the platform, the user interface, the underlying software, the agent system architecture, prompts, and the aggregated "Topical Experience" metadata systems.

8Affiliate Program & Referral Rewards

Our Affiliate Program allows referrers to earn promotional credit rewards by referring new users to the platform under the following conditions:

• Account Verification: Referred users must complete account registration and successfully complete their email double opt-in verification. Unverified signups will not qualify.
• Deferred Credit Payout: Referral rewards are deferred and only finalized/credited to the referrer's account balance upon the referred user's first successful billing transaction (actual spend on credits or subscription).
• Abuse Prevention: Synthetic referrals, bot farming, self-referral, or deceptive signups are strictly prohibited. We reserve the absolute right to audit affiliate dashboards, review signup logs, and permanently revoke credit rewards or suspend accounts if malicious affiliate activity is detected.

9Indemnification

You agree to defend, indemnify, and hold harmless thisisagency.ai, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service, your use of the platform, or any content you generate and publish using our AI agents, including claims of copyright infringement or unauthorized domain scraping.

10Limitation of Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL THISISAGENCY.AI BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS EXCEED THE TOTAL AMOUNT PAID BY YOU TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11Warranty Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. thisisagency.ai does not warrant that the service will be uninterrupted, error-free, or that AI-generated outputs will be accurate, complete, or suitable for any particular purpose.

12Termination

Either party may terminate this agreement at any time. You may close your account by contacting us at privacy@thisisagency.ai. We may suspend or terminate your access immediately if you breach these Terms or the Acceptable Use Policy.

Upon termination, your data will be handled in accordance with our Privacy Policy. All personal data and AI memory will be permanently deleted within 30 days of account closure. You may request an export of your data prior to account closure.

13Force Majeure

thisisagency.ai shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, third-party service provider failures, or cyberattacks.

14Modification of Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notification at least 14 days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.

15Governing Law and Jurisdiction

These Terms of Service constitute a legally binding agreement governed by and construed in accordance with the laws of Scotland and the United Kingdom.

Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the Scottish courts.

16Severability & Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and thisisagency.ai regarding your use of the platform, and supersede all prior agreements, understandings, and communications, whether written or oral.
